Parental Responsibility

Divorce and Family Law

The law is particularly harsh on unmarried fathers when it comes to parental responsibility.

What is parental responsibility?

If an unmarried father is not on the birth certificate or the child is born before December 2003, then effectively he has no legal rights concerning the child. Theoretically, he would not even have the right to look after his child or children if their mother died.

However, parents can avoid this legal trap by filling out a simple form signed by both parties and setting out the responsibility of each of them. Where a parent does not want to make such an agreement, then the next step is to apply to the courts.
